The CLARITY Act faced substantial barriers over the last few months. The fulcrum of discussion among policymakers was additional ethics language to prevent people in power from benefiting from the cryptocurrency market. The discussion especially eyed President Donald Trump’s own crypto empire. The Trump family has reportedly made more than $1 billion in profits from the cryptocurrency market since President Trump took office in January 2025. However, President Trump has agreed to the ethics language. We may see his name being removed from his family’s cryptocurrency ventures. This point was a major objection to several lawmakers and it may make things easier for the Senate.

Secondly, explicit protections against criminal prosecution were dropped. This was done to address certain prosecutors’ concerns. While it may appear as a defeat for developers, it could give better Senate support. Moreover, the updated bill has given more protections for developers, miners, and validators who don’t control customer funds.

The revised bill also includes a stablecoin circuit breaker. This would allow the US Treasury to intervene if community banks face widespread deposit outflows.
