OpenAI Files To Dismiss Elon Musk Lawsuit: Claims Harrasment

OpenAI is filing a motion to dismiss Elon Musk’s lawsuit against the company, accusing the billionaire Tesla founder of harassment. The artificial intelligence firm says Musk is using the court system to “harass” it to boost his own competing AI company, xAI.

In February 2024, Elon Musk filed a lawsuit against OpenAI, alleging that the company had strayed from its “not-for-profit” roots. Since the company has become a “for-profit,” Musk has rescinded that lawsuit, and instead filed a new one in August. In the August suit, Musk’s legal team alleged that OpenAI and its CEO, Sam Altman, “intentionally courted and deceived Musk, preying on Musk’s humanitarian concern about the existential dangers posed by artificial intelligence” and “assiduously manipulated Musk into co-founding their spurious non-profit venture, OpenAI, Inc.”

Musk also said he planned to ban Apple products from his company headquarters after the phone maker started a partnership with OpenAI, insinuating his supporters follow suit.

OpenAI Claims Harassment: Moves To Dismiss Elon Musk’s Lawsuit

OpenAI is now looking to dismiss the lawsuit altogether. According to the Wednesday filing, the company asks the judge presiding over the suit to dismiss the case outright. OpenAI’s legal team alleges that Musk is using the legal system to harass the company and that the billionaire’s claims have no legal merit. Per the filing, OpenAI says the lawsuit is “the latest move in Elon Musk’s increasingly blusterous campaign to harass OpenAI for his own competitive advantage.” OpenAI also claims that Musk once supported the company, however, he abandoned his support when his own AI venture failed.

OpenAI also alleges, in the document, that Musk is using the legal system to help his own company compete. “Since launching a competing artificial intelligence company, xAI, Musk has been trying to leverage the judicial system for an edge,” the filing says. “The effort should fail; Musk’s complaint does not state a claim and should be dismissed.”

The motion to dismiss Elon Musk’s lawsuit against OpenAI has set November 12th as the date for the civil suit.
